Definitions of Marketplace terminology
For any discrepancies between the definitions below and those found in the Collaborative Marketplace Agreement, the Collaborative Marketplace Agreement takes precendence.
Definitions of words and phrases
Application: The response a supplier submits in reply to this application. It comprises the application form, the supplier’s response and all other information submitted by a supplier.
Business day: Any week day in New Zealand, excluding Saturdays, Sundays, New Zealand (national) public holidays and all days from Boxing Day up to and including the day after New Year’s Day.
Confidential information: Information that:
- is by its nature confidential
- is marked by either the Lead Agency or you as ‘confidential’, or‘commercially sensitive’
- is provided by the Lead Agency, you, or a third party in confidence
- the Lead Agency or you knows, is confidential.
Confidential information does not cover information that is in the public domain through no fault of either the Lead Agency or you.
Contract: means the Collaborative Marketplace Agreement
Department: The Department is the Department of Internal Affairs only. The term Department includes its officers, employees, contractors, consultants, agents and representatives – referred throughout as our, us or we.
GETS: Government Electronic Tenders Service www.gets.govt.nz
GST: The goods and services tax payable in accordance with the New Zealand Goods and Services Tax Act 1985.
Intellectual property: All intellectual property rights and interests, including copyright, trademarks, designs, patents and other proprietary rights, recognised or protected by law.
Lead Agency: The Lead Agency is either the Department of Internal Affairs, or the Ministry of Business, Innovation and Employment, determined by the Channel, Catalogues and/or Services selected as part of the supplier’s Application. The term Lead Agency includes its officers, employees, contractors, consultants, agents and representatives – referred throughout as our, us or we.
Where the matter cannot be defined as associated with a Channel, Catalogue or Service, the Lead Agency is the Department of Internal Affairs.
Point of contact: The Lead Agency and each Respondent are required to appoint a Point of Contact. This is the channel to be used for all communications during the Application process. The Lead Agency’s Point of Contact is identified in Section 1, paragraph 1.3. The Respondent’s Point of Contact is identified in its Application.
Terms: Means the process, terms and conditions that apply to this application.
Requirements: The goods and/or services described in “Apply to be a supplier” which the Lead Agency intends to list in Marketplace.
Selection approach: The approach used by the Lead Agency to grant suppliers member status.
